This document was drafted by an agent and is not legal advice. A lawyer should read it before it is submitted to an app store.

1. Agreement

By playing SlapTopia, you agree to these terms. If you don't agree, don't play — there's nothing to cancel, because there's no account.

SlapTopia is operated by Blacktop Social LLC ("we", "us").

2. What you get

A licence to play the game for your own personal, non-commercial enjoyment. That licence is personal to you, non-exclusive, and revocable.

You may not:

• copy, sell, sublicense, or redistribute the game or its assets;
• reverse-engineer it for the purpose of republishing it, or ship a derivative of it;
• use it to break the law, or to harass anyone.

The game, its art, its audio, its code, and the name SlapTopia are ours or licensed to us. Nothing here transfers ownership of any of it.

3. The leaderboard, and the name you type

SlapTopia has one global, public, all-time leaderboard. The display name you type is published on it, alongside your score and force numbers. See the Privacy Policy for exactly what is stored.

By typing a display name and finishing a run, you are choosing to publish that name.

You must not use a name that:

• is another person's real name, or impersonates anyone;
• is a slur, harassment, sexual content, or a threat;
• is advertising, spam, or a link;
• infringes someone else's trademark or other rights.

We may remove or change any display name, or remove any leaderboard entry, at any time and without notice. We do not undertake to review names before they appear, and a name appearing on the board is not our endorsement of it.

4. Scores are not guaranteed to be genuine

The game runs entirely on your device, and the server accepts what your device reports. Basic checks exist to stop scripted nonsense; they cannot prove any score was earned by playing.

Read the leaderboard as a scoreboard, not as a record book. We make no representation that any entry on it is genuine, and we may remove entries we believe are not.

Deliberately submitting fabricated scores — by modifying the game, calling the API directly, or otherwise — is a breach of these terms, and we may remove your entries and block further submissions.

5. Purchases and unlockable worlds

Some worlds unlock by playing. Some are unlocked by an entitlement, which may be granted or purchased.

• Purchases made through the Apple App Store or Google Play are handled by that store, under that store's terms and its refund policy. We do not process your payment and never see your payment details.
• Entitlements are stored on your device. Clearing your browser storage, switching browsers, or switching devices loses them, because there is no account to restore them to. Purchases made through an app store can normally be restored through that store's own restore mechanism.
• Content in a paid world may change, and a world may be modified or withdrawn — including for legal or app-store-compliance reasons.

6. slapd, and your hardware

slapd is an optional helper that reads your Mac's built-in motion sensor so that hitting the laptop flaps your citizen.

Read this part properly:

• The game measures the force of an impact. It does not ask you for one, reward one, or make a harder hit worth anything mechanically. Hitting harder buys you nothing in the game, deliberately and by design.
• You are responsible for your own hardware. Striking a computer can damage it, and damage caused by hitting your device is not covered by us, and is very unlikely to be covered by your manufacturer's warranty.
• Do not hit a device that isn't yours. Do not hit a device someone is holding.
• Keyboard, touch, and mouse input play the whole game. The accelerometer is a novelty, not a requirement.

7. Availability

The game and the leaderboard are provided as-is and may change, break, or go away. The leaderboard is a free service running on infrastructure we do not own; we do not promise it will be reachable, and the game is playable without it.

We may modify or discontinue any part of SlapTopia at any time.

8. Disclaimers and liability

To the fullest extent permitted by law:

• SlapTopia is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost progress, lost entitlements, or damage to your hardware.
• Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you actually paid us for SlapTopia in the twelve months before the claim, or USD 50.

Some jurisdictions do not allow some of these exclusions, in which case they apply to you only as far as the law permits. Nothing here limits liability for fraud, or for death or personal injury caused by negligence, where that limit is not permitted.

9. Termination

You can stop playing at any time. We may stop providing the game, or remove your leaderboard entries, at any time — including for a breach of these terms.

10. Changes

If these terms change materially, the "last updated" date at the top changes with them. Continuing to play after that means you accept the change.

11. Governing law

These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Disputes are subject to the state and federal courts located in New York, and you and we consent to their jurisdiction — without prejudice to any mandatory consumer-protection rights you have where you live, which nothing here is intended to displace.
